These Terms of Service ("Terms") are an agreement between you and Shelton Performance LLC (doing business as Phenometrics) ("Phenometrics," "we," "us") governing your use of phenometrics.app, app.phenometrics.app, and related services (the "Service"). By using the Service you agree to these Terms and to our Privacy Policy.
Phenometrics provides tools for movement screening, personalized training and habit programs, progress tracking, wearable-data insights, and collaboration between coaches and their clients.
Coaches using the Service are independent professionals responsible for their own advice, programming, and client relationships. Phenometrics provides the software they use; it does not supervise or guarantee any coach's services. Exercise involves inherent risk — use your own judgment and train within your abilities.
Connecting a third-party account (such as WHOOP, Oura, Fitbit, Google Health Connect, or Withings) is optional, subject to that provider's own terms, and can be revoked by you at any time. We are not responsible for the accuracy or availability of third-party data or services.
You agree not to: misuse or interfere with the Service; attempt unauthorized access to accounts or systems; scrape or harvest data; upload malicious code; use the Service to violate any law; or resell the Service without our written agreement.
You retain ownership of the information you submit. You grant us the license needed to host, process, display, and transmit it in order to operate and improve the Service, consistent with our Privacy Policy. We may use de-identified, aggregated data to improve the Service.
The Service — including its software, design, screens, scoring frameworks, and content we created — belongs to Shelton Performance LLC or its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use it; they don't transfer any ownership.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. Insights and AI-generated content can contain errors and are provided for informational purposes only.
To the maximum extent permitted by law, Shelton Performance LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim or $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify Shelton Performance LLC against claims arising from your misuse of the Service or violation of these Terms.
You can stop using the Service and request account deletion at any time. We may suspend or terminate access for violation of these Terms or to protect the Service and its users. Sections that by their nature should survive (including 7–11) survive termination.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.
We may update these Terms. For material changes we will give notice by email or in-app before they take effect. Continuing to use the Service after changes take effect means you accept them.
